If I Terminate a Deal, Can I Go Back and Make Another Offer?

The answer is, it never hurts to try. Sometimes you’ll get lucky and sometimes you won’t. Let’s say you enter an agreement to buy a condo, but the agreement is conditional on your lawyer reviewing the Status Certificate. The Status Certificate reveals a few things that make you nervous, so you terminate the deal. You sleep on it and wake up the next morning feeling less nervous. You call your agent and say “I’ve changed my mind and would still like to buy that condo.” Your agent prepares the same agreement as before, but without the condition. The seller accepts it. Deal done. That was simple, wasn’t it? This exact thing just happened to one of our clients and he definitely got lucky! But he could also have been unlucky because the seller could have said “You seem flaky. I don’t want to have to worry that you won’t close so I’m not selling it to you” or “I’ll sell it to you but at a higher price to compensate for the aggravation you’ve caused me” or, perish the thought, “I already sold it to someone else last night”. So yes, you can always make another offer, but you never know what might happen.
